(InfoCatólica) El Congreso Nacional de Honduras aprobó el pasado jueves una reforma de la Constitución que blinda la prohibición absoluta del aborto que ya existe en el país. Para que en un futuro se pueda legalizar dicho crimen, hará falta que las tres cuartas partes de dicho Congreso lo aprueben, algo virtualmente imposible.
También ha quedado reforzada la institución familiar con la prohibición constitucional (art 112) del matrimonio civil entre homosexuales.
La delegación de la ONU en el país centroamericano ha reaccionado pretendiendo que tales acciones son contrarias a los derechos humanos.

El sistema (sic) de Naciones Unidas en Honduras expresa su preocupación por la aprobación de la reforma que incorpora la prohibición absoluta del aborto en el artículo 67 de la Constitución hondureña y del artículo 112 referente a la prohibición del matrimonio igualitario.
Al respecto, la ONU reitera que esta reforma constitucional contraviene las obligaciones internacionales en materia de derechos humanos, pues impide el abordaje de un problema de salud pública que la penalización del aborto en todas sus modalidades ya provoca. De igual modo, dicha reforma podría aumentar la situación de desigualdad y discriminación por razones de género en el país.
De acuerdo con la Relatoría Especial sobre la Tortura y otros Tratos o Penas Crueles, Inhumanas y Degradantes, «La existencia de leyes muy restrictivas, que prohíben los abortos incluso en casos de incesto, violación, deficiencia fetal o cuando está en riesgo la vida o la salud de la madre, vulneran el derecho de las mujeres a no ser sometidas a tortura o malos tratos.»
En lo que respecta al matrimonio igualitario, el sistema de Naciones Unidas en Honduras lamenta que, en el decreto aprobado, sean restringidos los derechos de una persona a partir de su orientación sexual, su identidad de género y/o su expresión de género, contraviniendo la Opinión Consultiva 24/2017 de la Corte Interamericana de Derechos Humanos, y el principio de progresividad y no regresión de derechos humanos, afectando a dos colectivos tradicionalmente vulnerables: mujeres y personas LGBTI.
La reforma constitucional aprobada se contrapone a lo establecido en el artículo 373 de la Constitución hondureña, que establece que la reforma de la ley fundamental podrá decretarse con dos terceras partes de la totalidad de miembros del Congreso. Al establecer la mayoría calificada de tres cuartas partes para la reforma de los artículos referentes al aborto y al matrimonio igualitario, se trasgrede el alcance del artículo 373, mismo que se encuentra dentro de los artículos que no pueden reformarse en ningún caso, según lo establecido en la Constitución de la República de Honduras.
En virtud de lo anterior, el sistema de Naciones Unidas en Honduras exhorta al Congreso Nacional a reconsiderar la ratificación de dicha reforma y, en el futuro, asegurar la concertación de cualquier proyecto de ley con los grupos directamente afectados, para garantizar su discusión en los tres debates exigidos por la Constitución de la República. Asimismo, reafirma su disponibilidad para brindar asesoría técnica al Congreso Nacional en esta materia.
